Preamble: Many of the issues I bring to you are very small, yet each issue is just that, an issue. If you take care of the small issues, then you will be able to build and more importantly, focus on the bigger issues...a larger practice and more family time.

Assignment of Rights


Do you have your patients sign an “Assignment of Benefits” when they start care? The purpose of the assignment is to have the insurance company send you the benefits directly, so you do not have to run after your patient to get paid. As an assignee of benefits, you have certain rights to seek the status of your claim and when you are getting paid, and that is about it in most states. If you have to sue the insurance company in small claims court, go to arbitration or any other legal forum to secure payment, you could be prevented from doing so.
 
To secure that right, you have to have your patient give you the “Right” to do so. Therefore, you have the patient assign their rights to you, as well as their benefits. If you don’t have the legal right, then you are forced to go after your patients and in many instances, you will end up working for free. That is not fair. To resolve this issue, simply add the following language in the patient responsibility section:
 
For professional or medical expense benefits allowable and otherwise payable to me under my current insurance policy as payment toward the total charges for professional services rendered.
 
THIS IS A DIRECT ASSIGNMENT OF MY RIGHTS AND BENEFITS UNDER THIS POLICY.
 
By taking this step in your patient assignment area, you now retain the right to do what's necessary to collect your fees.
