“Another FRYE Moment”

I just received another phone call from a lawyer who wants a referral for a doctor who can withstand a Frye hearing. For those of you who never read the consults, but only the emails (stupid-stupid-stupid and I don’t care if you are insulted…I am only interested in your success…What are you interested in?), a Frye hearing is an expert hearing. In some states, they are called voir dire and others at the state and Federal levels are called Daubert hearings. Thankfully, there is a doctor in the region of this lawyer and the doctor will be getting LOTS of referrals…Why?

The lawyer had a client who was a victim in a pedestrian knockdown and had an endplate fracture and 3 wedge deformities. The neurosurgeon, although acknowledging the multiple fractures, will NOT opine on causality. This is the rule with most any medical specialist; he/she will not discuss causation. Initially, I thought the medical specialist was being aloof or arrogant and would not deal with anything beneath him/her such as a medical-legal issue. However, I have come to realize they are simply not trained in how to do so and if they were, they would. The reason…it would make the lawyers like them more and they would get more referrals. In addition, I am getting more requests from medical specialists to teach them our medical-legal technology because they now NEED more business and are determined to take the referrals from you.  

The conundrum for the lawyer is who does he/she get to opine on causality who concurrently can pass a Frye hearing to be conferred as an expert? For me, I simply went to the US Chiropractic Directory and directed the lawyer to the chiropractor’s CV and the doctor got the referral. This is the second time I was able to do this for this doctor…ONLY because the doctor had his CV posted. Everything else is simply BS and lawyers will look elsewhere and usually for different MD’s not realizing that the RIGHT chiropractor is the best doctor for their cases. 

If you want to win…have the knowledge, the credentials and your CV posted on the US Chiropractic Directory…It matters!!!!!!
