Preamble: many of these issues I bring are small, yet each issue is just that… an issue. If you take care of the small issues, then you will be able to build and focus on the larger issues… a larger, more profitable practice along with more family time. 

“Beware of the Doctor Using Templates”

In the lawyer’s handbook that I have been referencing, there is a chapter on “Beware of Treating Doctors Using Templates.” The author writes:

Defense medical examiners are not the only one to use cut – and – paste or lengthy templates. Treating doctors do also, and you need to be alert for this. Why? Because cutting and pasting the exact same symptoms for each visit is choosing laziness over accuracy; this is bad doctoring, regardless of who does it. Most patients simply do not have the exact same symptoms on each visit, and this can expose your client, your case and the Dr. to embarrassing cross-examination.

Since I am getting this information directly from the lawyer’s handbook it is safe to assume that the defense counsel will also have a copy of this section. Therefore, you leave yourself exposed to the following in cross-examination:

Dr., I have a book here authored by a plaintiff’s lawyer and even they say you shouldn’t cut and paste your treatment notes. Do you agree that was inappropriate?

At this point in time no matter what you say the jury will already have heard that an authoritative source stated your records are lazy at the expense of accuracy. You can also never lose sight of the fact that you will rarely, if ever be on the witness stand, however that is how the lawyers will judge you. And as I have repeated many times, lawyers will not start with you if they feel they cannot finish with you.

It is for this reason that I have strongly urged you to consider utilizing Software Motiff as your EMR program. It is the only program in the industry that has text randomization, meaning it re-writes the paragraphs for you and although it says the same thing it is different. I also abhor records that report “the first stated symptom… The second stated symptom… Etc.” as this too is a templated computerized report that reads as such. Both the plaintiff’s attorney and the courts will see it as is; a computerized generated templated report and that is problematic. I have been thrown off the witness stand in the past for presenting such reports and I don’t want you in the same embarrassing situation. Beyond that, in every circumstance the lawyer never worked with me again.

Should you have invested tens of thousands of dollars in another software system I urge you to redesign the templates and spend the extra time so they don’t all read the same.
