Quickie Consult 94 I

From the Desk of Dr. Mark Studin

Preamble: Many of the issues I bring to you are very small, yet each issue is just that, an issue. If you take care of the small issues, then you will be able to build and more importantly, focus on the bigger issues...a larger practice and more family time.

"Lawyers' Feedback"

I lectured this past week to 40 lawyers; 38 of them had heard me speak before.  As a result of my relationship with virtually all of them, I was able to ask very specific "probing" questions along with watching their responses to my presentation.

The top 4 issues were the following:

4. Research: They need more current research to prevail in their cases and be taught how to apply it. Basically, they need help in understanding it to apply it to their cases. Therefore, your monthly meetings are becoming more critical.

3. Testifying: I explained my testifying policy as I have outlined in great detail in the consultations. This is a huge issue because we become the "insurance policy" in marginal cases as well as the quarterback for them in all of their cases.

2. Spinal Biomechanical Engineering: This is a credential they can ride like "Seabiscuit." This is a credential almost ZERO other experts have and will give you the competitive edge in the medical-legal marketplace for soft tissue cases. Over the next 2-3 weeks, I will be explaining more about this certification.

#1. MRI Spine Interpretation: You must have a certification. The lawyers say so, the carriers say so and now the legislators and regulators say so. What is it going to take until you realize there is no longer any choice if you choose to win in the personal injury marketplace? This has become the arbiter for most lawyers nationally as to whether they will even consider working with you. In the past, it was important to get you to the witness stand, at least in their minds...Today, it is required to get most lawyers to even say "hello" to you. The courts and carriers are getting tougher for them to deal with and in our world, only the "credentialed" will survive.

These guidelines are the roadmaps to success because the lawyers say so...and they set our standards in the medical-legal world. We either listen and meet the needs of the courts or we fail at personal injury.
