Preamble: many of these issues are small, yet each issue is just that… an issue. If you take care of the small issues, then the larger issues often take care of themselves and you can focus on the larger issues… a larger, more profitable practice and more family time.

“The Science and the Facts”

In the lawyer’s handbook that I have been referencing, there is a chapter on “Forcing Doctors to Show you the Science.” The author writes:

Show the Dr. that you have the science to support your position; then ask them to provide the science that supports his position. Branding guidelines and articles to the proceeding. Offer to let the doctor use your computer to find an article that supports the case (or his opinion). Usually, he will be unable or willing to. Cross – notice the Dr. to trial or deposition by serving him/her with the same subpoena you used for the deposition. If the Dr. still brings no articles or science to support his position, point out that you have__ articles from __ journals supporting your position and he has none. When the Dr. claims “studies show,” tell him you are connected to the Internet and ask them to produce one of the alleged “studies.”

I have clearly outlined in the past why you need “evidence-based macros” to ensure getting paid, however this is an equally important reason for both learning the material and having it at your fingertips. Lawyers are trained as “seekers of facts” to determine specifically what you know and don’t.

You must be well read and have the information organized at your fingertips! 

In order to get paid you must be able to document the evidence behind what you do and in order to succeed in personal injury you must be current in contemporary research. There is no shortcut!
