“Compliance Dilemma”

Dr. Manoni sent this to me yesterday with a question from a doctor who has retained him to write a rebuttal against an IME whore who lied in the denial:

He has included a lumbar spine/pelvic diagnosis with no patient complaint of low back pain and no orthopedic exam of the lumbar spine save deep tendon reflexes and some palpation findings.  Adjustments and radiographs were performed in these regions without an exam.
Is this a potential problem for him?

The answer is simple. This doctor CANNOT fight the improper denial from the IME whore. He has to walk away from legitimate services rendered without ever having a prospect of getting paid because he didn’t follow the simplest rule. For each area adjusted, x-rayed or treated at any level, you need a complaint, clinical exam findings and a diagnosis. This is non-negotiable. 

I have seen many doctors charged that LOST for RICO racketeering violations for doing the same. 

Follow the rules and get paid without having to look over your shoulder for the balance of your career.
