"State Association's Poor Guidance"
A few weeks ago, I reached out to 1 state association to inform them of a court ruling they were aware of, but it had further reaching ramifications than they realized. After getting comments on how I was "greedy" from the executive director and very negative e-mails from board members, I decided to call the board members who had issues with me. After each conversation, the board member was surprised on how well informed I was on the issue and he/she had no idea what was going on in his/her own state. In fact, he/she was appreciative that I was working so hard to protect chiropractic in his/her state.
The issue was, and is on a chiropractor's ability to testify on MRI.
It appears, based upon a tough court ruling that the courses offered by that state organization did not meet the standards of the courts, and DC's statewide were ruled by one trial court judge to not be allowed to testify on MRI. Although this was only 1 judge, the implications were huge both statewide and nationally.
I argued with the state organization that the MRI certification course (www.TeachDoctors.com) I started working on 5 years ago, was designed specifically for today's marketplace and offered it to them as a "real-time" solution that was vetted both by the state's Trial Lawyers Association and their own lawyer. Not only did they ignore me and my membership application as a business partner in advanced support of them, they also wrote a letter to every DC in the state to not be concerned as they had everything under control. The letter informed doctors not to be worried over the concerns of a few (me) on the MRI issue and that they were bringing a specialist in to educate and credential them in 8 months.
Here are the real issues and problems:
First, last week alone, 3 of our doctors in that same state were questioned by the courts with the exact same issues brought up by the judge who barred "all DC's" from testifying. Although that case is still in the appeals process, other judges and defense lawyers are now raising the same issues in today's trials and depositions.
In all 3 cases, our doctors, who had all gone through our MRI certification program, were allowed to testify with no restrictions. We are now 3 for 3 since the court ruling was rendered. This was last week. How many other DC's who have not earned their certification will testify over the next 8 months until the state finally gets around to giving the course, will be disallowed from testifying, thereby creating numerous legal precedents against the chiropractic profession? And...will the state organization be careful in how they credential DC's because it cannot be business as usual? This requires a different approach to ensure our ability to be expert. The implications, both positive and negative, are far reaching.
Our doctors have now been credentialed in most states as expert in MRI because we have had 5 years of "tinkering" with the formula. After reading court decision after court decision in state after state we are confident that we exceed the standards in both the state in question and every state...for today. I am also confident that over time, there will be other challenges and we will meet them with solutions based on your clinical excellence and credentials. However, for today, it is clear that you must be not only credentialed in MRI, but certified.

- Accreditation Council for Continuing Medical Education (ACCME) in joint sponsorship with the State University of New York at Buffalo, School of Medicine and Biomedical Sciences for category 1 AMA PRA credits
- University of Bridgeport, Division of Health Sciences Postgraduate Education Department certified for chiropractic post-doctoral continuing education
- Academy of Chiropractic Post Doctoral Division, Recognized by the PACE Program of the Federation of Chiropractic Licensing Boards
These accreditations are one of the PRIME reasons that judges accept our doctors as expert. You MUST get certified to compete and succeed in today's marketplace.
I also acknowledge that this commentary is self-serving as we sell this course. However, the certification will also be a profit center for you once you position yourself properly. Just ask the doctors who get barred from testifying if the lawyers that brought them into court will ever work with them again...They won't and they WILL tell their friends.
